eLab Terms of Use
RX Orthotic eLab app for clinics · Effective date: October 23, 2026 · Version: 2026-10-23
These Terms of Use ("Terms") are an agreement between RX Orthotic Inc ("RX Orthotic", "we", "us") and the clinic ("Clinic") and each person the Clinic authorizes ("User") to use the RX Orthotic eLab iPhone app and its related services (the "App"). By tapping I agree in the App, you accept these Terms for yourself and confirm you are authorized to accept them for your Clinic. If you do not agree, do not use the App.
These Terms work alongside the Clinic's existing account terms, pricing and any business associate agreement ("BAA") with RX Orthotic. If they conflict, the signed agreement between the Clinic and RX Orthotic controls.
1. Who may use the App
- The App is for licensed healthcare clinics that are RX Orthotic customers, and their authorized staff.
- RX Orthotic creates each User's login. Logins are personal: do not share your password or let others use your account.
- The Clinic is responsible for everything done under its Users' logins, and must tell us promptly if a login may have been misused or a User leaves the Clinic, so we can disable it.
2. What the App does — and does not do
- The App lets Users record a clinician's prescription, capture 3D scans and photos of a patient's feet, send orders to our laboratory, see order status and tracking, and message the lab.
- The App does not diagnose, treat or give medical advice. All clinical decisions — including the prescription, device choice and fit — are made by the Clinic's licensed clinicians, who remain responsible for patient care.
- Scans and measurements are used to fabricate devices. Their accuracy depends on how they are captured; the clinician is responsible for checking that scans, measurements and order details are complete and correct before sending.
3. Orders
- An order sent through the App is a purchase order from the Clinic, priced under the Clinic's account with RX Orthotic.
- Change and cancellation requests are best-effort: once an order is in production — usually within 24 hours — it may not be possible to change or cancel it, and work already done may be charged.
- Reorders and remakes requested in the App are handled under RX Orthotic's remake and warranty policy.
- Delivery dates and tracking shown in the App are estimates from the lab and the carriers.
4. Patient information
- The Clinic decides what patient information to enter and send, and is responsible for having each patient's authorization or another lawful basis under HIPAA and California law to share it with RX Orthotic for fabrication.
- Enter only the information needed for the order.
- RX Orthotic handles patient information as described in the RX Orthotic eLab Privacy Policy (https://rxorthotic.com/pages/privacy) and, where in place, the BAA between the Clinic and RX Orthotic.
- Patient data stored on the Clinic's iPhone is the Clinic's responsibility: protect the device with a passcode, keep iOS up to date, and remove patient data (Settings → Sign out → remove patient data) before a phone leaves the Clinic.
5. Acceptable use
Users must not: use the App for anything unlawful; upload anything other than order information, scans, photos and order forms; try to access other clinics' data or our systems beyond what the App provides; interfere with the App's security or operation; or copy, reverse engineer or resell the App, except as the law allows.
6. Ownership
RX Orthotic and its licensors own the App, its software, design and content, and the RX Orthotic and RX Orthotic eLab names and logos. The Clinic keeps its rights in the information it sends, and gives RX Orthotic permission to use that information to make, ship, support and invoice its orders and to improve its services, as described in the Privacy Policy. The App includes open-source software listed in Settings → About → Open-source licenses, used under those licenses.
7. Availability and changes
We work to keep the App available and secure, but it may be unavailable at times for maintenance or reasons outside our control. Orders that cannot be sent stay on the iPhone and are sent when the App reconnects. We may update the App and these Terms; if we change the Terms in a significant way, the App will ask Users to accept the new version.
8. Ending use
The Clinic may stop using the App at any time, and Users may delete their account in Settings → Request account deletion. We may suspend or disable a login or a Clinic's access if these Terms are breached, the account is closed, or to protect patients or our systems. Orders already placed are handled under the Clinic's account terms.
9. Disclaimers and liability
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT ALLOWED BY LAW, RX ORTHOTIC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. RX Orthotic's warranty on the devices it makes is set out in its product warranty and remake policy, not in these Terms. TO THE EXTENT ALLOWED BY LAW, RX ORTHOTIC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, ARISING FROM THE APP, AND ITS TOTAL LIABILITY FOR CLAIMS ABOUT THE APP IS LIMITED TO THE AMOUNT THE CLINIC PAID RX ORTHOTIC FOR THE ORDERS GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE IT. Nothing in these Terms limits liability that cannot be limited by law.
10. Governing law
These Terms are governed by the laws of the State of California. Disputes will be resolved in the state or federal courts in Los Angeles County, California.
